Fishing vessels under administrative sanctions from the Ministry of Fisheries and Aquaculture.

It is the legal responsibility of the fishing vessel owner to comply with current legislation, as well as to adhere to the rules governing the management, registration, and monitoring of fishing activity. Considering the administrative procedures and processes, it is common practice that, upon renewal of the Fishing Authorization, any non-conformities are raised, and the consequences, as stipulated in regulations, may include the suspension of fishing activity for predetermined periods (which may vary according to the specific regulatory act and context).

The reason for the suspension is mainly due to malfunctions in the tracking system (National Satellite Vessel Tracking Program – PREPS) or the failure to submit or the late submission of Logbooks.

The validity and provisions contained in the Fishing Vessel Regularization Program, PROPESC, allow for reductions in suspension time and updates to the validity of Fishing Authorizations, providing for periods of 10 years.

In addition to the suspension of fishing activities for a specific period of time, another sanction applied is the cancellation of the Fishing Authorization, which can occur at the request of the supervisory body, by court order, at the request of the vessel owner, and when the fishing vessel is active during the suspension period.

It should be noted that the status of a penalty may be altered as a result of administrative measures and judicial decisions.
